“So many people vaping in bathrooms sometimes, it’s hard to do anything about it,” Ms Dhiman said, adding that she doesn’t vape.
The FDA’s efforts to limit teens’ access to flavored e-cigarettes have had little impact on Lizzie Burgess’ ability to get them in suburban Indianapolis over the past four years. She told me that at age 16, she became addicted in the weeks after she started smoking. A gas station, old friend, or website that sells e-cigarettes in flavors like banana ice cream or sour apple always said she was.
At 19, he said he vaporized THC and used a device — now advertising tobacco-free nicotine — that contains as much nicotine as two packs of cigarettes every two to three days. He said he suffered from an illness that started like a cold and ranged from rapid breathing to almost gray lips and a feeling of exhaustion. When she went to the emergency room, her oxygen saturation was 67, well below the normal 95 or higher range. Ms Burgess said she was in the intensive care unit soon after due to vaping-related lung injury.
She is struggling to end her nicotine addiction and has dropped to two cigarettes a day.
“I think the FDA should pull them all off the market now,” said Ms. Burgess about the flavored vapors. “I think it’s going to be very, very difficult for them to wrap it all up. It’s huge and there are too many companies right now.”
Synthetic nicotine remains much more expensive than the tobacco-derived product, leading some industry experts to question whether a “synthetic” device label is correct.
Gregory Conley, president of the American Vaping Association, an industry trade group, said at this point the unregulated vaping market was a problem created by the FDA. He said the agency is fueling the problem by overregulating a product used by millions of adults who find electronic cigarettes a safer alternative to cigarettes.
“This country should learn some lessons from past bans that have failed miserably,” Mr Conley said. “If you don’t regulate fairly in a market where there is a lot of demand from legitimate adults, you are fueling gray and black markets where operators are not interested in checking IDs before selling.”
